Cross-Industry Joint Letter Calls for Practical EDPB Guidance Following Landmark CJEU Ruling

FEDMA is proud to be part of a broad coalition of broad range of European associations, including technology, telecommunications, automotive, finance, insurance, and media that has sent a joint letter to Ms. Anu Talus, Chair of the European Data Protection Board (EDPB). This initiative follows the recent CJEU ruling (C-413/23 EDPS v. SRB), which clarified that, under the right safeguards, pseudonymised data can be considered anonymous in certain contexts.
Why is this important for our industry?
- The ruling opens new doors for responsible data use, AI development, and innovation, while maintaining strong data protection standards.
- However, organizations need clear, practical guidance to implement these principles and ensure compliance.
What does the joint letter propose?
- A revision of the EDPB’s draft Guidelines 1/2025 to reflect the Court’s context-based, risk-driven approach to personal data.
- A participatory format for the 12 December multistakeholder event, bringing together representatives from various industries to share practical use cases and help shape guidance that is workable and future-proof.
- Consolidated guidance on both pseudonymisation and anonymisation, and broader consultation with other data regulators, in line with the EDPB’s commitments under the Helsinki Statement.
This cross-industry effort demonstrates the shared commitment to fostering innovation, legal certainty, and practical solutions for Europe’s data-driven economy. By working together, we can ensure that data protection rules both safeguard individuals and empower organizations to innovate responsibly.
