ePrivacy Overview

Law no. 506/2004 of 17th November 2004 regarding the processing of personal data and the protection of privacy in the electronic communications sector (Lege nr. 506 din 17 noiembrie 2004 privind prelucrarea datelor cu caracter personal şi protecţia vieţii private în sectorul comunicaţiil or electronice) implemented Article 13 of the EU Privacy and Electronic Communications Directive (ePrivacy Directive). The Romanian ePrivacy law came into force on 28th November 2004 and has been amended by the Government Emergency Ordinance no. 13/ 2012, by law no. 82/ 2012 and by law no. 235/ 2015.


In regard to cookies, the provisions of the amended Article 5(3) of the EU Directive 2002/58/EC became effective on 26th of April 2012, with the Government Emergency Ordinance No. 13/2012 (G.E.O. No. 13/2012) amending and completing Law No. 506/2004 on processing of personal data and the protection of private life in the electronic communications sector.


Law No. 365/2002 on electronic commerce (Romanian E-commerce Law) implemented Directive 2000/31/EC on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market (Electronic Commerce Directive).


In January 2017, the European Commission published a proposal for an ePrivacy Regulation.
