It is permissible to send direct marketing fax to individuals unless the number is registered on the Do Not Call Register. It is still permissible to send a fax to a number registered on the Do Not Call Register if the subscriber has consented to the sending of the fax.
Business telephone numbers are not eligible for DNC registration, however business numbers used primarily for transmitting and/or receiving faxes may be registered.
In the case of a number used for both personal and business use (including dual-purpose phone/fax lines), the number may be eligible for registration if it is used mostly for private/domestic purposes.
Fax marketers are not able to fax people during the following times, unless a fax recipient has consented to be faxed at that time: a weekday before 9.00 am or after 8.00 pm; a Saturday before 9.00 am or after 5.00 pm; a Sunday; a national public holiday. These times refer to the time of the day at the fax recipient’s usual residential address (Fax Marketing Industry Standard 2011).
