Directive on Electronic Commerce (2000/31/EC)
 
The EC will be revising the directive in 2008, and is already preparing studies this year. FEDMA is waiting for any developments.
 
Background
 
The Electronic Commerce Directive, adopted in 2000, set up an Internal Market framework for e-commerce. The EC hoped to increase legal certainty for business and consumers through the harmonization of rules on issues such as the transparency and information requirements for online service providers, commercial communications, electronic contracts and limitations of liability of intermediary service providers.
 
The Directive is the last bastion of the country of origin principle, which means that information society services are, in principle, subject to the law of the MemberState in which the service provider is established.
